My new publication about the evidentiary threshold in Indonesia

My article titled ‘Truth, Bias and Abuse of Power: How Indonesia’s Evidentiary Threshold Shapes Criminal Justice’ was just recently published in the International Journal of Evidence and Proof (Sage Journal). It discusses the foundation for why nations choose high or low thresholds. Apart from that, it also discusses in detail why Indonesia emphasizes the quantity of evidence (the two-evidence rule) to justify enforcement actions ranging from an arrest to a conviction. My article about history of Indonesian Criminal Procedure Code

My article, ‘Authority, Rights and Reform,’ exploring the historical context of Indonesia’s 1981 Criminal Procedure Code (KUHAP), has recently been published in the Asian Journal of Comparative Law. The article examines how the parliamentary debates from 1979 to 1981 reflected a clash between rights-based and authoritarian ideologies, which ultimately shaped KUHAP’s design. Recognizing the upcoming changes to KUHAP, this work extends beyond historical analysis to offer predictions for its reform, arguing that understanding its foundational complexities is crucial for effective change.

New journal article discussing the evolution of marijuana policy in a global and Indonesian context

My article discussing the evolution of marijuana policy in a global and Indonesian context has been published by Jurnal Hukum Pembangunan. This article is written in Bahasa Indonesia.

This article explores the global debate around marijuana laws and their potential impact on Indonesia. It examines the shift in some countries from viewing marijuana as a criminal issue to a health issue, and questions whether Indonesia might follow suit. However, the article finds that such a shift is unlikely in Indonesia. This is because Indonesian lawmakers tend to see marijuana use as a moral issue, not just a legal one. Past laws have created a strong stigma against marijuana, making reform difficult. Additionally, recent legal changes and the flexibility in current regulations may lead to resistance from legal authorities who benefit from the status quo. In conclusion, the article suggests that despite the global trend toward marijuana legalization, Indonesia’s unique cultural and legal context makes significant reform unlikely in the near future.

An exclusive interview with Metro TV delves into the controversial dismissal of the KPU Chairman

Better late than never! Back in June 2024, I had the privilege of being interviewed on the Metro TV podcast. The discussion centered around my recent work representing my client in pursuing litigation ethics against the chairman of the Indonesian General Election Commission (KPU).

As many of you may be aware, the Ethics Council has since taken decisive action and dismissed the former chairman. This case underscored the critical importance of maintaining the highest ethical standards within our electoral processes.

During the podcast interview, I had the opportunity to elaborate on the legal complexities involved in this matter. I also shared insights into the challenges and rewards of advocating for ethical conduct within such a high-profile context.

While this blog post comes a few months after the interview, its message remains timely. The pursuit of justice and the upholding of ethical standards are ongoing endeavors.
