My article, ‘Authority, Rights and Reform,’ exploring the historical context of Indonesia’s 1981 Criminal Procedure Code (KUHAP), has recently been published in the Asian Journal of Comparative Law. The article examines how the parliamentary debates from 1979 to 1981 reflected a clash between rights-based and authoritarian ideologies, which ultimately shaped KUHAP’s design. Recognizing the upcoming changes to KUHAP, this work extends beyond historical analysis to offer predictions for its reform, arguing that understanding its foundational complexities is crucial for effective change.
